The WOMO Online Shop and You

By accessing the WOMO Online Shop and website owned by WOMO Pty Ltd as well as placing orders you agree to the WOMO Online Shop terms and conditions.

The WOMO Online Shop Terms and Conditions include these terms and conditions, the Returns Policy, and Privacy Policy and Shipping policy. 

WOMO Pty Ltd reserves the right to amend the WOMO Online Shop Terms and Conditions from time to time without notice. Your continued use of the WOMO Online Shop will constitute acceptance that You are bound by the Online Shop Terms and Conditions as amended.

Terms of Sale

The WOMO Online Shop is located in Australia. All prices shown are in Australian Dollar (AUD) and are inclusive of 10% Goods and Service Tax (GST). For international orders please refer to our shipping policy.

By placing an order through the WOMO Online Shop shopping card, you are offering to purchase the products placed in the shopping card, which are subject to the following terms and conditions. All orders placed are subject to availability and confirmation of the order price.

We are committed to dispatch orders as soon as orders are received, processed and funds settled into our account. Dispatch times may vary according to availability and reachability of postal addresses in rural areas and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible for. Contract formation

In order to contract with WOMO Pty Ltd through the WOMO Online Shop, you must be over 18 years of age and possess a valid online payment method issued in your name or be authorized to use the chosen payment method. WOMO Pty Ltd retains the right to refuse any request made by you.

As soon as you place an online order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have processed payment of the Contract Price. Once funds settle into our account, we mark your order as processed and an invoice will automatically be sent to your email you provided through the check-out process or once your order is processed and goods dispatched.

Right of Refusal or Cancellation

We reserve the right to refuse, cancel or impose special conditions upon a contract subject to giving reasons to you. We will notify you if this is the case and return any payment that you have made. Such refusal or cancellation may result from the below:

  • The product being ordered is unavailable from stock
  • Inability to obtain authorisation of payment;
  • The identification of an error within the product information, including price or promotion; or The inability to effect delivery due to an error in your information after reasonable attempts have been made to contact you to obtain the correct information. 

Delivery fees will be charged for orders above 10KG gross weight per order, delivery fee for orders below 10KG weight per order are free of delivery charge. Once an order has been processed it cannot be cancelled and the item must be returned to us in accordance with the Returns Policy.

Pricing and Stock Availability

Whilst we try to ensure that all details, descriptions and prices which appear on the WOMO Online Shop and Website are accurate, errors may occur. 

  • If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. 
  • If we are unable to contact you, we will treat the order as cancelled. 
  • If you cancel your order prior to goods being dispatched and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of GST. Delivery and any applicable administrative costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Total Cost’.

For typographical errors or other errors or inaccuracies and may not be complete or current to the services or product descriptions we, therefore, reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the services or products that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

We will endeavour to supply all items publicised in the WOMO Online Shop. Products that are no longer available will be removed from the Online Shop as soon as Plumbscan becomes aware that those items are out of stock or unavailable. There may be unavoidable occasions when:

  • All or part of your order cannot be fulfilled immediately; or
  • All or part of your order cannot be fulfilled at all.
  • Where part of an order cannot be fulfilled immediately, the part that can be fulfilled will be dispatched as soon as possible.
  • Where part of your order cannot be fulfilled at all You will be advised as soon as possible by email or telephone.
  • Products with a limited sales period displayed in the WOMO Online Shop will have the withdrawal date clearly shown.
  • Where a product becomes unavailable, but that item is ordered by You before Plumbscan has withdrawn that item from the Online Shop, You will be advised by email or telephone that Plumbscan cannot fulfil your order and the purchase price of the item in question will be refunded.

Payment

Our WOMO Online Shop accepts Visa, MasterCard and DirectDebit payment methods. Once your payment method has been validated, upon clicking “PLACE ORDER” we will debit your nominated form payment immediately for the full order amount unless stipulated otherwise.

For using third party payment providers such as Google pay, Apple pay, AfterPay or PayPal you will be bound to the third party payment providers terms and conditions.

Once orders are placed and payments are processed, they cannot be cancelled by you, unless they state an error or are unavailable as stated in Right of Refusal or Cancellation and Pricing and Stock Availability.

Specific Promotions

We may run promotions on our WOMO Online Shop from time to time which are subject to both these terms and any additional promotion-specific terms which are incorporated into these Terms by reference. 

Promotion-specific terms may include conditions in respect of selected products, colours, collections, purchase periods, purchase methods, minimum spend requirements, bundle discounts, partner promotions, games of chance or games of skill. Any active promotion-specific terms will be presented on this page.

You should ensure that you read the specific conditions that apply to each promotion. By proceeding to purchase you agree and accept the terms of the applicable promotion(s).

Indemnity

You agree to indemnify, defend and hold harmless WOMO Pty Ltd, its directors, employees, consultants, agents, and affiliates, from any and all third- party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of this Website or your breach of the Terms of Service.

Variation of Terms

WOMO Pty Ltd shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services, terms and/or any page of this Website and Online Shop.

WOMO Pty Ltd reserves the right to change prices of products listed in the WOMO Online Shop without notice.

WOMO Pty Ltd reserves the right to engage third party companies and contractors to carry out services under these terms and conditions.

Complaints and Jurisdiction

We have complaints procedures in place, which we will use to try to resolve disputes when they first arise: please let us know if you have any complaints or comments by contacting our customer service via email info@womo-filter.com.au or phone 0450 014 185 or via letter mail to the address: WOMO Pty Ltd, Unit 14/ 4 Flindell Street, WA-6163 O’Connor, Australia.

Complaints are handled discrete; however, customer information may be shared with product manufacturers or suppliers if an issue cannot be resolved by WOMO Pty Ltd and requires assistance from manufacturers or product suppliers. 

These terms and conditions are to be construed in accordance with the laws of Western Australia, Australia and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of Western Australia, Australia.

Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Entire Agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and WOMO Pty Ltd. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of WOMO Pty Ltd.  

Use of the Company Name 

The customer will not use the name of WOMO Pty Ltd or WOMO or its logo and product images in advertising, stationery, business cards, literature or social media without the prior approval of WOMO Pty Ltd other than in the case of material supplied by WOMO Pty Ltd to the customer.

Intellectual property

The materials displayed on this website, including all editorial materials, information, photographs, illustration, artwork and other graphic materials, and names, logos and trademarks, are the property of WOMO Pty Ltd and are protected by Trademark and other intellectual property laws. WOMO Pty Ltd does not grant any license or right in, or assign all or part of, its intellectual property rights in the content or applications incorporated into the website or in the user interface of the website.

Any such content may be displayed and printed solely for your personal and non-commercial use. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any such material to any third party without the prior written consent of WOMO Pty Ltd.

Third party websites

The WOMO Online Shop and website may contain links to other websites operated, controlled or produced by third parties.

Unless otherwise indicated WOMO Pty Ltd does not control, endorse, sponsor or approve any such third party websites or their content nor does WOMO Pty Ltd provide any warranty or take any responsibility whatsoever for any aspect of those websites or their content.

Wholesalers

Wholesaler are bound to these terms and conditions as well as shipping policy and returns policy in conjunction with the credit accounts terms and conditions wholesalers receive when applying for a credit account. Any sale specials are coordinated by WOMO Pty Ltd and communicated to wholesalers in advance to allow preparation of stock levels available.
